The Do Not Call list, managed by the FTC, works in conjunction with the Telemarketing Sales Rule (TSR), which is governed by the Federal Communications Commission. If you ever feel confused or like you aren’t sure which rule goes with which agency, this is part of the reason why. 

In addition, “The do not call provisions of the TSR cover any plan, program or campaign to sell goods or services through interstate phone calls,” according to the FTC

You can think of the TSR as a more overarching set of guidelines, while the DNC list is a very specific part of that. No matter how you think of it, though, you want to make sure to follow Do Not Call guidelines, as the fines may be up to $46,517 per incident!

And in case you’re wondering, there are exceptions for charitable fundraising, political campaigns, business-to-business calls, and individuals with whom you have an existing relationship. There is also a safe harbor exemption for phone sales organizations that meet specific requirements, such as having written procedures, good training, and making calls erroneously. However, you still have to contend with an audit from the FTC. 

A foolproof way to follow Do Not Call guidelines with every call

So, how do you follow Do Not Call guidelines? It may seem daunting at first, but it’s not so difficult once you have the right protocols in place. It’s even less difficult when you have live scrubbing. But let’s back up a bit. 

Your first step is to subscribe to the Do Not Call registry, at which point you get a Subscription Account Number (SAN). You then subscribe to specific zip codes and download a list of numbers. By the way, not every telemarketing situation requires a SAN. To learn more, take a look at this post

At this point, you have some options. The most challenging choice, and the one most likely to lead to mistakes, is to scrub your list manually as you make calls. For obvious reasons, we don’t recommend this approach. 

Our suggestion is to use dialing software to help you follow Do Not Call guidelines. Even then, however, you have choices. There are numerous dialing software solutions to choose from.
